The approved provider must ensure that all children attending the outside school hours care program must be at least 4 years of age by 30 June in the year they attend the program.

The approved provider must ensure that only children who are currently enrolled in, and attend or will attend, a school in the current year attend the outside school hours care program.

The approved provider must ensure that an educator be directly supervising and physically in close proximity to any child in their care who is near or using the swimming pool at the premises of the education and care service.

The approved provider must ensure a comprehensive risk assessment, compliant with regulation 101 - Conduct of risk assessment for excursion, is completed prior to each occasion the pool will be accessed by educators and children being educated and cared for by the service.

The approved provider must ensure a parent authorisation compliant with Regulation 102 - Authorisation for excursions, is obtained prior to each occasion the pool will be accessed by educators and children being educated and cared for by the service.

The approved provider must ensure that when children are inside the fenced pool area there must be no less than one educator for every four children being educated and cared for by the service in the fenced pool area.

The approved provider must ensure that the relevant number of educators educating and caring for the children remaining outside the fenced pool area accords with the ratio prescribed by regulation 123(1)(d) as if the remaining children constituted all the children attending the service at the relevant time.

The approved provider must ensure that children are directly supervised as they move between the indoor and the outdoor spaces.
