For the purposes of regulation 126(1)(a) a maximum of two educator who have an approved certificate III qualification as listed on ACECQA can be counted in the ratios of diploma educators on a maximum of two days per week.

The approved provider must take reasonable steps to recruit educators who have, or are actively working towards, at least an approved diploma level education and care qualification.

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required.
